Terms applying to purchases and subscriptions on tintico.coffee

These terms and conditions of sale (the “Terms”) are entered into between ZENNO SAS, whose registered office is at 4 RUE DE LA REPUBLIQUE, 69001 Lyon, registered with the Lyon Trade and Companies Register under number 908 337 082, SIRET 908 337 082 00014, VAT FR55908337082, share capital 7000,00 €, hereinafter “ZENNO”, operator of the TINTICO website https://tintico.coffee/, and any natural or legal person wishing to make a purchase via the TINTICO website, https://tintico.coffee/, hereinafter the “Customer”.

By creating a customer account on https://tintico.coffee/ or by placing an order, the Customer acknowledges having read, accepted and agreed to comply with these Terms.

The legal notice, personal data protection policy and pricing information available on the Site also apply to contracts concluded via the Site.

No other contractual terms from documents issued by the Customer shall apply between the Parties unless expressly accepted by ZENNO.

1. Definitions

  • Customer: a natural or legal person with legal capacity who has identified themselves on the Site and placed an order for a Product or taken out a Subscription. The Customer may be a consumer or a professional.
  • Login: the Login consists of an email address and, where applicable, a password chosen by the Customer, or any other authentication method offered on the Site. The Login is required to access the Customer account, place orders and manage a Subscription.
  • Products: the Products are those presented and offered for sale on https://tintico.coffee/, in particular Tintico coffee tablets and related items. They have been selected by ZENNO. Each Product is identified by its name and product sheet, which set out its essential characteristics (origin, composition, use, etc.).
  • Subscription: a successively performed contract under which the Customer receives selected Products at the chosen frequency, billed each cycle, with no minimum commitment, under Article 10.
  • Site: the Site is an e-commerce website for the sale of Products and Subscriptions, accessible at https://tintico.coffee/. The contract concluded between the Parties via the Site is a distance contract.

Differences between the Product shown on the Site and the Product received by the Customer may result from technical presentation constraints (colour, lighting, photography). Except where differences relate to an essential characteristic of the Product and affect its quality, they shall not be treated as a lack of conformity or grounds to cancel the sale.

2. Purpose

These Terms set out the conditions under which the Customer purchases the Products and/or takes out the Subscriptions offered on the Site.

They detail the rights and obligations of each Party.

3. Access to the Site – Customer account – Login

3.1 Access to the Site

Access to the Site is free for all visitors and does not require registration.

To order Products or take out a Subscription, the Customer must create a Login to access their Customer account.

3.2 Creating a Customer account

Creating a Customer account is free and is done via the Site.

To create an account, the Customer must complete the registration form under their own responsibility, providing their details and Login. The information requested is required to process orders and Subscriptions. The Customer must keep this information up to date. This obligation is the Customer's sole responsibility.

Holders of a professional account acknowledge that they cannot benefit from the Consumer Code provisions that apply exclusively to consumers.

3.3 Logging in – Customer account

Any connection to the Site using the Login is deemed to have been made by the Customer.

ZENNO shall not be liable for any loss caused by fraudulent use of the Login.

If the Login is lost, stolen or used without authorisation, the Customer may change their password under “My account” or notify ZENNO without delay via customer service, so that ZENNO can deactivate the Login as soon as possible.

4. Order process

The Customer may order Products via the Site and must identify themselves beforehand. Subscriptions are also governed by Article 10.

4.1 Identification on the Site

The Customer expressly acknowledges that entering their Login constitutes identification.

4.2 Conclusion of the order – double click

The sales contract is validly formed when, after entering their Login, the Customer has placed the order (first click), has been able to read and accept the Terms, has checked the order details and total price, has corrected any errors and has confirmed the order with a second click, in accordance with Articles 1127-1 et seq. of the French Civil Code.

The double-click procedure constitutes the Customer's consent and makes the sums due for performance of the order payable to ZENNO.

In accordance with Article L. 221-14 of the French Consumer Code, any order confirmed by the second click creates a payment obligation.

4.3 Confirmation of the sales contract

ZENNO sends the Customer an email confirming conclusion of the sales contract. That email also provides the Terms on a durable medium, the information referred to in Article L. 221-5 of the French Consumer Code, and an order number.

An invoice is made available to the Customer, including in “My account”. ZENNO recommends that the Customer keep the acknowledgement email and the invoice.

4.4 Proof of the transaction

ZENNO keeps computerised records of orders and payments under reasonably secure conditions. Archived order forms and invoices may therefore be produced as evidence, which the Customer expressly acknowledges.

4.5 Performance of the order – unavailability of Products

ZENNO undertakes to use its best efforts to fulfil Product orders, but can only do so within the limits of available stock. In the event of a stock shortage, ZENNO will inform the Customer as soon as possible.

4.6 Changing or cancelling a one-off order

As long as the order has not been put into preparation or shipped, the Customer may request a change or cancellation via customer service, stating the order number. ZENNO will endeavour to process the request, without guaranteeing it once logistics processing has started.

Once the parcel is being prepared or has been handed to the carrier, the order can no longer be cancelled from the Site. The Customer may then, where applicable, exercise the right of withdrawal under Article 9.

5. Pricing

5.1 Prices

The prices shown on the Site are those in force on the date the sales contract is concluded. They are displayed in euros including VAT and may be increased by delivery charges that vary according to geographic area, volume and weight, and by any handling fees indicated at the time of order.

In the event of an obvious and gross typographical error in the displayed price, the sale may be cancelled.

5.2 Price changes

The VAT rate applied is the legal rate in force on the date of the transaction. If the applicable VAT rate changes, prices including VAT will be adjusted immediately, without prior notice.

ZENNO may change the prices of its Products and services at any time. However, changes will not apply to one-off orders once the sales contract has been validly formed (Article 4). The rules for Subscriptions are set out in Article 10.9.

5.3 Promotional codes and offers

Promotional codes or offers (free delivery, discount, commercial operation) may be offered on the Site. Unless otherwise stated, they are not transferable, cannot be combined with each other, and cannot be combined with the Subscription discount.

ZENNO may withdraw or change an offer at any time. An offer applies only to orders or cycles for which it was validly entered and accepted before payment confirmation.

6. Payment

6.1 Payment

For a one-off order, the full price must be paid at the time of order; receipt of payment by ZENNO triggers preparation and then dispatch of the Products.

For a Subscription, each cycle is paid on the processing date of the scheduled shipment, in accordance with Article 10.5.

Any payment made before delivery is neither a deposit nor a down payment.

6.2 Payment methods

A one-off order may be paid by card or PayPal, depending on the options displayed at checkout.

A Subscription is paid exclusively by card. A valid payment method is stored at signup and used for each renewal. PayPal is not offered for Subscriptions, as renewals are charged off-session.

The Customer warrants that they have the authorisations needed to use the chosen payment method. ZENNO reserves the right to suspend processing of any order or Subscription if payment is refused, if the Customer fails to pay, or in the event of a dispute relating to a previous payment.

ZENNO may implement an order verification procedure to ensure that no one is using another person's payment details without their knowledge. In that context, the Customer may be asked to send via customer service a copy of an identity document and/or a masked copy of the card used, together with proof of address. In that case, the order will only be validated after receipt and verification of the requested documents.

7. Retention of title

ZENNO retains title to the Products sold until the price has been paid in full, including incidental amounts. Non-payment, even partial, may result in ZENNO reclaiming the Products.

8. Delivery of Products

8.1 Delivery method

The available delivery methods are detailed on the Site and restated at the time of order or Subscription (home delivery, pickup point, etc.).

If the address is incomplete or incorrect, or if any information required for delivery is missing, ZENNO shall not be liable for the final quality of the Products or for resulting delays or failed deliveries.

Tintico coffee tablets are sensitive to heat. The Customer is invited to store them away from heat and light, in accordance with the product sheet. During heatwaves, ZENNO may limit delivery methods to carriers able to preserve Product quality. Some options may be temporarily hidden.

8.2 Countries that can be delivered

Delivery is available in the countries and areas shown on the Site at the time of order, provided the chosen payment method is accepted.

The Customer is responsible for checking whether the laws applicable in their country allow them to place an order.

For delivery outside France, customs duties, taxes or local formalities may apply. They are borne by the Customer, unless otherwise stated at checkout.

8.3 Receipt of the Product

When ordering, the Customer may designate a third party to receive the Product, including via carrier instructions or by choosing a pickup point.

8.4 Delivery times – termination of the sales contract

Delivery times start only from the date of full payment of the order (or, for a Subscription, from the processing date of the relevant cycle). They are expressed in working days and are, in principle, stated at the time of order.

In general, delivery within the stated times can only take place if the Customer has fulfilled all of their contractual obligations towards ZENNO.

In accordance with Articles L. 216-1 et seq. of the French Consumer Code, and unless ZENNO indicates otherwise, delivery must take place no later than thirty days after conclusion of the contract.

If the deadline is not met, the consumer or non-professional Customer may require ZENNO to perform within a new period. Notice must be sent by recorded delivery with acknowledgement of receipt to: ZENNO SAS – 4 RUE DE LA REPUBLIQUE – 69001 Lyon. If performance does not occur within that new period, the Customer may terminate the contract in the same way.

If the sales contract is terminated under the above conditions, ZENNO undertakes to refund the consumer Customer all sums paid, no later than fourteen days after the date on which the contract was terminated.

8.5 Delivery issues caused by transport

Any delivery anomaly (damage, missing item compared with the delivery note, damaged parcel, broken Products, etc.) must be noted by hand on the delivery note, together with the signature of the Customer or the designated third party.

Reservations must be as precise as possible. The wording “subject to unpacking” will not be recognised in the event of a dispute.

For these reservations to be taken into account, the Customer must confirm the anomaly by sending the carrier, within three (3) working days of the delivery date, a recorded letter with acknowledgement of receipt setting out the claims, and send a copy to ZENNO via customer service.

9. Right of withdrawal

9.1 Time limit – starting point

The consumer Customer has 14 calendar days from the date the Product is received by them or by a designated third party, or from receipt of the last Product if the order contained several Products not delivered together, to exercise the right of withdrawal, in accordance with Article L. 221-18 of the French Consumer Code.

For a Subscription, the withdrawal period runs from conclusion of the Subscription contract, under Article 10.10.

9.2 Exercising the right of withdrawal

To exercise the right of withdrawal, the consumer or non-professional Customer may, at their choice, do so online for a Subscription from My account > Subscriptions, send an unambiguous request via customer service, submit the model withdrawal form at the end of these Terms, or use the form provided on the Site. In the latter case, ZENNO will promptly send an acknowledgement of receipt on a durable medium.

The consumer must return the Products to ZENNO (or to a third party designated by ZENNO) within a maximum of fourteen (14) days of communicating the decision to withdraw.

Apart from the cost of returning the Products, which is borne by the Customer, the right of withdrawal is free of charge (refund of the Product and standard shipping).

However, if the consumer Customer chose a more expensive delivery method than the standard method offered on the Site, ZENNO will refund only the amount of standard delivery.

In accordance with Article L. 221-23 of the French Consumer Code, the right of withdrawal cannot be exercised where Products are diminished in value as a result of handling other than that necessary to establish their nature, characteristics and functioning.

ZENNO will not refund Products that have been opened (security seal removed) or that are not in perfect resale condition.

ZENNO refunds the consumer Customer once the Products have been recovered or once the Customer provides proof of return, using the same payment method as the original transaction, unless the Customer expressly agrees to another method.

9.3 Exclusion of the right of withdrawal

The right of withdrawal cannot be exercised in the cases provided for in Article L. 221-28 of the French Consumer Code, including:

  • the supply of goods made to the consumer's specifications or clearly personalised;
  • the supply of goods liable to deteriorate or expire rapidly;
  • the supply of goods which have been unsealed after delivery and cannot be returned for reasons of hygiene or health protection, including coffee tablets whose seal has been removed.

Withdrawal requests may be sent via customer service, the Site withdrawal form, or, for a Subscription, online from My account > Subscriptions.

10. Coffee tablet subscriptions

This article applies, in addition to the other provisions of these Terms, to any Subscription taken out on the Site. In the event of a conflict, these stipulations prevail for the Subscription.

10.1 Nature of the Subscription

The Tintico Subscription is a successively performed contract, with no minimum term, under which the Customer automatically receives the selected Products at the chosen frequency, until pause, modification or cancellation.

The Subscription is open to any Customer with an account and a valid card payment method.

10.2 Signup

Signup takes place on the Site, from the Subscription area or the Customer account. The Customer chooses the Products, quantities, frequency, first shipment date, address and delivery method, then stores a card payment method.

The Subscription contract is formed under the double-click procedure (Article 4). ZENNO confirms signup by email, with a summary of the chosen settings and these Terms on a durable medium.

10.3 Subscription settings

At signup, and at any time from their account, the Customer sets in particular the following parameters:

  • Products and quantities: eligible coffee tablets and, where applicable, other Tintico Products;
  • shipment frequency: every 1, 2 or 3 months;
  • first shipment date, chosen by the Customer from the dates offered on the Site;
  • delivery address;
  • delivery method and, where applicable, pickup point;
  • the card payment method stored for renewals.

When creating a Subscription, the Customer may indicate daily consumption; the Site may then suggest a frequency and quantity for guidance only. Those suggestions are not contractual: only the settings confirmed by the Customer apply.

10.4 Pricing benefits

Unless otherwise stated on the Site at signup, the Subscription includes a 10% discount on eligible coffee tablets. This discount does not apply to limited editions, gift boxes, or other Products added to the Subscription.

Delivery may be free according to the terms displayed at signup (in particular pickup point / Colissimo). Any conditions linked to a minimum number of tablets, a geographic area or a carrier are those shown on the Site when the relevant cycle is ordered.

These benefits do not necessarily combine with other promotional codes, unless otherwise stated.

10.5 Billing and renewal

Each Subscription cycle is billed on the processing date of the scheduled shipment, according to the chosen frequency. The amount corresponds to the Products in the cycle, minus the Subscription discount where applicable, plus any additional Products and, if they apply, delivery charges.

A confirmation email is sent for each charge. Invoices and history are also available in the Customer account.

The Customer undertakes to keep a valid payment method. If payment fails, the Subscription may be placed in payment incident status; ZENNO may suspend the cycle, retry payment and, failing regularisation, cancel the Subscription.

10.6 Changes by the Customer

The Customer may change their Subscription at any time from My account > Subscriptions, within the features offered on the Site, including: Products and quantities, frequency, next shipment date, delivery address, delivery method or pickup point, and payment method.

Changes apply to upcoming shipments. If a cycle is already being processed, prepared or shipped, the changes apply to the following cycle.

The Customer is invited to make changes early enough before the processing date shown in their account. ZENNO cannot guarantee that a change requested after processing of the cycle has started will be taken into account.

10.7 Pause

The Customer may pause their Subscription from their account. During a pause, no new cycle is prepared or charged.

The Customer may resume the Subscription at any time. The next shipment date is then recalculated according to the settings in force.

10.8 Cancellation by the Customer

The Subscription has no commitment: the Customer may cancel it at any time from their account, with no cancellation fee.

Cancellation takes effect for cycles that have not yet been put into preparation. A cycle already paid, in preparation or shipped remains due and will be delivered. Products already delivered remain subject to Articles 9, 11 and 12.

ZENNO may ask for a cancellation reason to improve the service; this information is not a condition of cancellation.

10.9 Changes to terms and prices by ZENNO

ZENNO may change the Subscription offer (unit prices, discount rate, free-delivery conditions, available frequencies, eligible Products, carriers).

Changes are notified to the Customer by email and/or via the Site, within a reasonable time before they apply to the next cycle. They do not apply to a cycle already paid.

If the Customer does not accept the new terms, they may pause or cancel the Subscription before the next processing date. Otherwise, renewal constitutes acceptance of the updated terms, subject to mandatory provisions of the French Consumer Code.

Any change in the applicable VAT rate applies immediately to subsequent cycles.

10.10 Withdrawal applicable to the Subscription

The consumer Customer has 14 calendar days from conclusion of the Subscription contract to exercise the right of withdrawal, in accordance with Article 9, including online from My account > Subscriptions.

If the Customer asked for the first shipment to take place during that period, they remain liable for the price of Products already delivered that cannot be returned, in particular if unsealed for hygiene reasons.

After the withdrawal period expires, the Customer remains free to cancel the Subscription under Article 10.8.

10.11 Product unavailability

If a Product in the Subscription becomes unavailable for a cycle, ZENNO will inform the Customer as soon as possible. Depending on the case, the Product may be omitted from the cycle, postponed, or replaced with the Customer's agreement.

Unavailability of a Product does not automatically cancel the Subscription.

The Subscription is managed from My account > Subscriptions. If you have any difficulty, contact customer service.

11. After-sales relations

11.1 Customer service

After the sale, the Customer may contact ZENNO with any questions via customer service.

11.2 Exchange requests

An exchange request must be sent to ZENNO via customer service or by post to: 4 RUE DE LA REPUBLIQUE – 69001 Lyon.

ZENNO allows seven (7) clear days from receipt of the order (carrier proof of delivery being authoritative) to request an exchange. An exchange is not automatic and is assessed case by case. In any event, the returned Product must be in perfect resale condition.

The exchange request must state the order number.

If the replacement Product costs less, ZENNO will issue a credit for the difference. If it costs more, the Customer will pay the balance by card.

11.3 Warranty

Products sold on the Site by ZENNO benefit from the legal guarantee of conformity under Articles L. 217-3 et seq. of the French Consumer Code and the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code. Under these guarantees, ZENNO undertakes, at the Customer's choice, to refund or exchange defective Products or Products that do not match the order.

The legal guarantees of conformity and/or hidden defects do not apply if deterioration of the Product is natural or results from an act of the Customer or the carrier (except where the carrier's liability is engaged under Article 8).

To make a warranty claim, the Customer must send an unambiguous request via customer service.

Upon receipt of the request, ZENNO sends the Customer an acknowledgement. It may include a return form and the address to which the Product must be sent.

The returned parcel must include the Product, the completed return form where applicable, and a copy of the purchase invoice. Incomplete requests will not be processed by ZENNO.

12. Return costs

Only in the case of the legal warranty, and provided the Product is found to have a hidden defect or lack of conformity and the warranty is applied, return costs incurred by the Customer for the warranty claim and reshipping costs are borne by ZENNO.

By contrast, where the warranty is not upheld, or where the Customer exercises the right of withdrawal or an exchange, the Product is returned at the Customer's expense.

In accordance with Article L. 221-5 of the French Consumer Code, the cost of return need not be communicated to the Customer before conclusion of the sales contract where the Products can be returned by standard post.

13. Liability

ZENNO is fully liable to the consumer Customer for proper performance of the obligations arising from the Product order or the Subscription.

ZENNO may nevertheless be released from all or part of its liability by proving that non-performance or improper performance is attributable to the Customer, to an unforeseeable and insurmountable act of a third party, or to force majeure.

14. Miscellaneous

The Parties expressly accept that information may be exchanged by email or via the Site forms.

The Site is available in French, English and Spanish. In the event of a discrepancy in interpretation, the French version of these Terms prevails.

All elements of the Site (trade marks, logos, texts, visuals, photographs, videos, graphics) are protected. Any unauthorised reproduction or use of the Tintico brand or of the Site content is prohibited.

ZENNO may update the Terms at any time, in particular to reflect legislative changes and case law. The applicable version is the one in force on the date the contract is concluded (one-off order) or, for a Subscription, the version accepted or notified to the Customer under Article 10.9.

If any provision of these Terms is void, it shall be deemed unwritten, without affecting the validity of the remaining provisions.

Any tolerance or waiver by either Party in applying all or part of the commitments under these Terms, whatever its frequency or duration, shall not amount to a variation of the Terms or create any right.

Processing of the Customer's personal data is described in the personal data protection policy.

15. Dispute resolution

These Terms are governed by French law.

In the event of a dispute, the consumer or non-professional Customer may refer the matter to a consumer mediator before bringing proceedings before the competent court.

If the Customer is a professional, exclusive jurisdiction is expressly conferred on the Lyon Commercial Court.

Withdrawal form

Please complete and return this form only if you wish to withdraw from the contract.
